1. Introduction
Welcome to SS Audiology Eighty Pty Ltd. These Terms of Service (“Terms”) govern your access to and use of the website located at https://ssaudiologyeighty.online (the “Website”) and the audiology and hearing care services supplied by SS Audiology Eighty Pty Ltd (the “Services”).
By accessing this Website, requesting a quote, booking an appointment or otherwise engaging our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use this Website or our Services.
We recommend that you read these Terms carefully, together with our Privacy Policy, before using this Website or engaging our Services.
2. About Us
SS Audiology Eighty Pty Ltd (ABN 57 702 553 964) is an Australian company providing audiology and hearing care services, including hearing assessments, hearing aid fittings and adjustments, tinnitus support, earwax management and ongoing hearing health care.
Our principal place of business is Melbourne VIC, Australia, and we provide services to clients across the Melbourne metropolitan area and surrounding communities.
References in these Terms to “we”, “us”, “our” or “the Company” mean SS Audiology Eighty Pty Ltd. References to “you” or “your” mean the user of this Website or the client engaging our Services.
3. Scope of These Terms
These Terms apply to:
- your use of this Website and any content published on it;
- requests for quotes, estimates or information submitted through this Website;
- appointments booked with us, whether online, by email or in person; and
- the supply of audiology and hearing care Services by us to you.
Where you engage us for clinical Services, additional documentation may apply, including consent forms, service agreements for hearing devices and practice policies provided to you at or before your appointment. If there is any inconsistency between these Terms and a signed service agreement, the signed service agreement will prevail to the extent of the inconsistency.
4. Health Information Disclaimer
The content published on this Website is provided for general informational purposes only. It is not intended to be, and must not be relied upon as, medical advice, a diagnosis or a treatment recommendation for any individual.
Hearing conditions can have a range of underlying causes, some of which may require medical management. Nothing on this Website replaces a comprehensive hearing assessment or a consultation with a qualified audiologist or your general practitioner.
If you experience sudden hearing loss, sudden or severe tinnitus, dizziness, discharge from the ear, significant ear pain or any other acute symptoms, you should seek medical attention promptly. Do not delay seeking medical advice because of anything you have read on this Website.
5. Appointments, Cancellations and Rescheduling
5.1 Booking an appointment
Appointment requests submitted through this Website, by email or in person are subject to confirmation by us. An appointment is not confirmed until we have notified you that the booking has been accepted and provided you with the appointment details.
5.2 Cancellation and rescheduling by you
We ask that you provide us with as much notice as possible if you need to cancel or reschedule an appointment. Where a specific cancellation policy applies to a particular Service (for example, a home visit or a mobile clinic appointment), we will advise you of that policy before the appointment is confirmed.
5.3 Cancellation by us
We may need to reschedule or cancel an appointment for reasons beyond our reasonable control, including illness, equipment availability or other operational circumstances. Where this occurs, we will contact you as soon as reasonably practicable to arrange an alternative appointment time.
5.4 Attendance
Please arrive on time for your appointment. If you arrive late, we may need to shorten the appointment or reschedule it, depending on the availability of our clinicians and the nature of the assessment.
6. Quotes, Estimates and Pricing
6.1 Quotations
Where we provide you with a quote for Services or devices, the quote is valid for the period stated in the quote (or, if no period is stated, for 30 days from the date of the quote). A quote is an offer to supply at the stated price and remains subject to confirmation of the scope of the Services required.
6.2 Estimates
Some matters, such as comprehensive diagnostic assessments or device repair work, may be provided as estimates rather than fixed quotes. An estimate indicates our anticipated fee based on the information available at the time and may change once the full scope of work is known. We will inform you of any material change to an estimate before proceeding.
6.3 Price variations
Prices may change from time to time. The price applicable to your engagement is the price stated in your confirmed quote or, where no quote was issued, the price advised to you at the time of booking.
6.4 Third-party costs
Our quotes may not include third-party costs, such as medical referrals, GP consultations, specialist ENT services or batteries and accessories not expressly listed. We will identify any known third-party costs where reasonably practicable.
7. Payment Terms
7.1 Payment of fees
Unless otherwise agreed in writing, fees for Services are payable at the time the Service is provided. For hearing devices, payment terms (including any deposit requirement) will be set out in your quote or service agreement.
7.2 Accepted payment methods
We accept the payment methods advised to you at the time of your appointment or stated on your invoice. We do not accept liability for any fees, charges or interest imposed by your bank, card provider or payment platform in connection with your payment.
7.3 Health fund rebates and government programs
You may be entitled to a rebate from your private health insurer or to support under an Australian Government hearing services program. Any rebate or entitlement is between you and the relevant fund, program or agency. We will, where applicable, provide you with the documentation you need to claim, but we do not guarantee the availability or amount of any rebate.
7.4 Overdue amounts
We may suspend the supply of non-urgent Services where an invoice remains unpaid after the due date stated on the invoice, until the outstanding amount is paid in full.
8. Hearing Aids and Devices
8.1 Device supply
Where we supply hearing aids or other hearing devices, the make, model, configuration and price of the devices will be confirmed in writing before the order is placed. Devices are ordered specifically for you based on your assessment results, and in most cases cannot be exchanged for an alternative model except in accordance with the applicable trial or return period.
8.2 Trial and adjustment periods
Where a trial or adjustment period applies to your device, the duration and conditions of that period will be stated in your service agreement. Devices must be returned in the condition in which they were supplied, fair wear and tear excepted.
8.3 Manufacturer warranties
Hearing devices supplied by us are typically covered by a manufacturer’s warranty. The terms of the manufacturer’s warranty (including its duration and exclusions) will be provided to you with your device. Nothing in these Terms limits any rights you may have under the manufacturer’s warranty or under Australian Consumer Law.
8.4 Care and use of devices
You are responsible for the day-to-day care, cleaning and safekeeping of your devices in accordance with the instructions provided to you. Damage caused by misuse, accident, unauthorised repair or exposure to moisture beyond the device’s rated protection may not be covered by warranty and may attract a repair or replacement charge.
9. Your Rights Under Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot lawfully be excluded.
Under Australian Consumer Law, our Services and any goods we supply to you come with guarantees that cannot be excluded. For Services, you are entitled to a refund or replacement for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Services rectified or re-supplied if they fail to meet a consumer guarantee and the failure does not amount to a major failure. For goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have the goods repaired or replaced if they fail to meet a consumer guarantee and the failure does not amount to a major failure.
Where the Australian Consumer Law applies and we are required to provide a notice of our consumer guarantee obligations in the prescribed form, that notice applies to the supply of our Services and goods.
10. Limitation of Liability
10.1 To the extent permitted by law
To the fullest extent permitted by law, and except as set out in these Terms or as required by the Australian Consumer Law, we are not liable to you for any loss, damage, cost or expense arising from your use of this Website or your reliance on any general information published on it.
10.2 Excluded loss
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, loss of opportunity or loss of data, arising in connection with these Terms, the Website or the Services.
10.3 No exclusion of statutory rights
Nothing in clause 10 applies to limit or exclude our liability for a breach of a consumer guarantee under the Australian Consumer Law, or for any other liability that cannot lawfully be excluded or limited.
11. Privacy and Health Information
We are committed to handling your personal and health information lawfully and appropriately in accordance with the Privacy Act 1988 (Cth) and, where applicable, the Australian Privacy Principles and health records legislation. Our Privacy Policy explains how we collect, use, store and disclose your information, including health information collected in the course of providing audiology Services.
